Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms. The definitions apply regardless of whether terms appear in singular or plural.
Application: means the mobile application titled “Honey Sleep,” including its related features, tools, content, and updates.
Company, We, Us, or Our: means Honey Sleep (“Honey”).
Device: means any device capable of accessing the Service.
Service: means, collectively, the Application and this website.
Your Content: means any sleep-profile answers, routine steps, notes, or other information You create, enter, or submit through the Application.
You: means the individual using the Service or, where applicable, the parent or legal guardian consenting on a minor's behalf.
Your access to and use of the Service is conditioned on Your acceptance of these Terms and the Honey Sleep Privacy Policy. By accessing or using the Service, You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You must discontinue use of the Service.
You represent and warrant that You are at least 13 years old.
If You are between 13 and 17 years old, You may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be fully responsible for all activity conducted using the Service.
Honey does not provide medical advice, sleep-disorder diagnosis, or professional health services. All sleep scores, estimates, and insights are automated approximations and may be incomplete or inaccurate.
Sleep estimates, scores, and insights are approximations only.
The Service is not intended to diagnose, treat, cure, or prevent any disease or sleep disorder.
You should consult a licensed healthcare professional for medical or sleep-related concerns.
Honey is not liable for inaccuracies in sleep estimates, scores, or recommendations.
You retain ownership of Your Content. By submitting Your Content, You grant Honey a limited, non-exclusive, royalty-free license to use, store, and process Your Content solely to operate, maintain, and personalize the Service for You, as described in our Privacy Policy.
You agree not to submit Your Content that is unlawful, infringing, or that You do not have the right to share.
Using the Service for any unlawful purpose
Reverse engineering, decompiling, or attempting to extract the source code of the Application, except as permitted by law
Attempting to gain unauthorized access to the Service or another user's account
Interfering with or disrupting the Service's operation or security
Misrepresenting Your identity or affiliation with Honey
Subscriptions and in-app purchases are billed and processed exclusively by Apple through Your App Store account. Honey does not process payments directly and does not store Your payment card or bank details.
Subscriptions automatically renew for the same duration and at the then-current price unless You cancel at least 24 hours before the end of the current billing period.
If Honey offers a free trial or promotional offer, it converts automatically into a paid subscription at the end of the trial period unless You cancel before the trial ends. Unused portions of a free trial are forfeited if You purchase a subscription during the trial period.
You can manage or cancel Your subscription at any time through iOS Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple in accordance with Apple's refund policies; Honey does not directly issue refunds for App Store purchases.
Honey's optional Screen Time features use Apple's Screen Time APIs to restrict apps You select during periods You configure. These restrictions are enforced by Apple's system frameworks. Honey is not responsible for restrictions that fail to apply, apply incorrectly, or are bypassed due to device settings, operating-system changes, or Apple platform limitations. You are solely responsible for the app and category selections You configure.
The Service relies on services provided by Apple, including Sign in with Apple, HealthKit, Screen Time, and the App Store. Your use of those services is also subject to Apple's own terms and policies. Honey does not control and is not responsible for the availability, accuracy, or performance of third-party services.
All rights in the Service, excluding Your Content, are owned exclusively by Honey or its licensors. You may not copy, modify, distribute, sell, sublicense, or reverse engineer any part of the Service.
You may stop using the Service and delete Your account at any time from the Profile section of the Application. Honey may suspend or terminate Your access if You violate these Terms. Upon termination, all rights granted to You under these Terms immediately cease.
The Service is provided without warranties of any kind, express or implied. Honey disclaims all warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Honey does not warrant that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, Honey's total liability for any claim arising from these Terms or Your use of the Service will not exceed the amount You paid to access the Service in the 12 months before the claim arose.
Honey is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or related to Your use of the Service.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to You.
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
Any dispute arising from these Terms or Your use of the Service will be resolved on an individual basis to the fullest extent permitted by law. You agree to waive any right to participate in a class action or representative proceeding against Honey.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. Honey's failure to enforce a right under these Terms does not constitute a waiver of that right.
Honey may update these Terms as the Service changes or as required by law. When we make material changes, we will notify You through the Application or by another appropriate method. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
If You downloaded the Application from the Apple App Store, You acknowledge that these Terms are between You and Honey only, not Apple, and Apple is not responsible for the Application or its content.
Apple has no obligation to furnish maintenance or support for the Application.
In the event of any failure of the Application to conform to any applicable warranty, You may notify Apple, and Apple will refund the purchase price, if any, for the Application; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Application.
Apple is not responsible for addressing any claims relating to the Application, including product liability claims, claims that the Application fails to conform to legal or regulatory requirements, and claims arising under consumer protection law.
Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the Application infringes intellectual property rights.
You represent that You are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon Your acceptance, will have the right to enforce these Terms against You.
